Terms and Conditions

I understand that by registering for this FitFlex SportX Adventures event I agree to abide by
the following terms and conditions:

  1. I understand that my registration fee is non-refundable if I drop out of the event for any
    reason.
  2. Cancellation policy:
    ⦁ If you cancel 45 days before the event, you will be entitled to your refund (if paid) less a Kshs.500 admin fee.
    ⦁ If you cancel 30 days before the event, you will be entitled to 50% refund (if paid)
    ⦁ If you cancel within 14 days before the event, no refund will be provided.
    ⦁ Substitutions are permitted up to 2 days prior to the event date.
    ⦁ No shows are responsible for 100% no refund at all.
  3. I understand that I have a responsibility for ensuring my own fitness to participate in the event and will declare all medical details if required.
  4. In the event that I become unable to compete, I will inform FitFlex SportX Adventures as soon as possible.
  5. In the event that I miss the organized physical event I am not entitled to claim my medal or any other give aways that may be issued in relation to the event.
  6. FitFlex SportX Adventures accepts no liability for any damage, injury or loss suffered by or to me, or to any other persons, or to any property in connection with the Challenge or otherwise.
  7. While FitFlex SportX Adventures will take every care with the staging of any event, assessing risks and providing care, I am aware that it is my responsibility to ensure my own safety and that of others and to ensure that I protect the environment and remain complaint to the safety rules as provided in the event venue. (This is not a personal accident policy, if an athlete trips over their own shoelaces and breaks an arm, for example, there is no automatic compensation) the participant acknowledges that personal accident and personal items insurance is his or her sole responsibility.

  8. FitFlex SportX Adventures reserves the right at any time to remove a participant from it’s event or prevent a participant participating in it’s event. Such action shall be at the sole discretion of FitFlex SportX Adventures due to misconduct by a participant, safety reasons, actions that may negatively affect other participants proper enjoyment of the event, acting in a manner that may cause a breach of peace or any other reason at the discretion of FitFlex SportX Adventures officials. No refund shall be made if the participant has acted negligently, maliciously, with wilful misconduct or otherwise without due care and attention for the event or other participants, so as to cause his/her removal. 
  9. If an event is cancelled for any reason by FitFlex SportX Adventures, the participant will be due a full refund or the opportunity to transfer to another event.
  10. You must be 18 or above to participate in a FitFlex SportX Adventures event. Any minors MUST be accompanied by an authorized parent/guardian who shall be directly responsible over the minor until the event is over.
  11. The participant consents to being photographed and filmed throughout the event and that these films and photographs may be used in any media for the purpose of advertising, publicity and otherwise in relation to the exploitation of the event (and future events) and/or the promotion of FitFlex SportX Adventures. 
  12. I understand that the itinerary can change at any time and without warning. We take great care and pride in planning our routes, However, GPS devices vary and from time to time we may need to amend published routes for safety reasons, we do our very best to avoid this. FitFlex SportX Adventures will not offer refunds if the route is shorter or longer than published.
  13. By agreeing to these terms, you are also agreeing to the terms and conditions of the events venue organization and service providers as shall have been agreed with FitFlex SportX Adventures.
  14. By agreeing to these terms, you are also agreeing to our Privacy Policy.
  15. The Kenya traffic laws apply and the participants have to follow the instructions of the police and race marshals. The cyclists shall wear helmets and have to ensure that their bicycles are fully functional to participate in the event. The participant is solely responsible for the condition of his or her bicycle(s)/equipment or any other personal property.
